1. Acceptance of Terms
By accessing or using the RafikiPeps Waste Management platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
RafikiPeps provides a cloud-based waste management ERP platform including fleet management, weighbridge integration, client portal, route optimisation, recycling marketplace, and compliance reporting tools. The Service is intended for use by waste management companies, municipalities, and their clients operating in Kenya.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Ensuring that all information you provide is accurate and up to date
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Attempt to gain unauthorised access to any part of the Service
- Transmit any malicious code, viruses, or harmful data
- Interfere with or disrupt the integrity or performance of the Service
- Collect or harvest any personally identifiable information from the Service
- Use the Service to send unsolicited communications
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.
6. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice. Failure to pay may result in suspension of your account.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of RafikiPeps Waste Management. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, RafikiPeps shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
